Concurrently, the Union Cabinet is set to approve a revamped Model Bilateral Investment Treaty (BIT) framework that significantly reduces the waiting period for foreign investors to initiate international arbitration from five years to one year after exhausting local remedies. However, the proposed BIT model strictly preserves India’s sovereign authority by excluding domestic taxation laws and judiciary jurisdictions from treaty-based dispute mechanisms.
